PRIVACY POLICY

Information Collection and Use
Aabalat is the sole owner of the information collected on this website. We will not sell, share, or rent this information to others in ways different from what is disclosed in this statement. Aabalat Fine & Rare Wines collects information from our users at several different points on our Aabalat Fine & Rare Wines website.

By using our website or purchasing a product from us, you agree to the collection and use of information as set forth in this privacy policy. We may from time to time this policy. We will post any changes to our policy on this page so that you are always aware of what information we collect and how we use your information.

You may, from time to time, receive information from us about new features, new services and special offers we think you'll find valuable. We won't share your email address with other companies. If you'd like to opt-out of receiving future mailings from Aabalat, follow the procedure outlined in the Choice/Opt-out section below.

Registration
No registration is required in order to use this website. While not required, creating an account makes future use quicker and more enjoyable. During account creation a user is required to give their name, date of birth, email address, zip code and a password. This information is used to contact the user about the services on our website for which they have expressed interest. It is optional for the user to provide a phone number, but encouraged so we can have another means to contact you should any reason arise regarding an order. Some delivery services require a phone number to contact you in the event a package cannot be delivered or someone is not available to take delivery.

Ordering
We request information from the user on our order form. Here a user must provide contact information (name, shipping address, etc...) and financial information (credit card number, expiration date, billing address and billing phone number). This information is used for billing purposes to verify the customer is of legal age and to fill customers' orders. If we have trouble processing an order, this contact information is used to get in touch with the user. This information is taken in a secure area, is encrypted for our customers' protection, and is not sold or shared with anyone else under any circumstances.

Gift Recipients
We collect contact information for gift recipients in order to ensure correct gift delivery. We do not sell or rent any contact information for gift recipients, but they may, from time to time, receive information from us about new features, new services and special offers that we think they'll find valuable. We always allow gift recipients to opt-out of receiving future mailings.

Cookies
A cookie is a piece of data stored on the end-user's hard drive containing information that relates directly to the end-user's visit to our website. Any information placed in the cookie is accessible only to Aabalat and will not be sold or shared with anyone else under any circumstances. We use a cookie to store a unique session identifier and this allows us to maintain your shopping cart and state selection from one page request to the next. We are also able to maintain your session information from one visit to the next. By setting a cookie on our site, the user would not have to log in more than once, thereby saving time while on our site. If a user rejects the cookie, they may still browse our website. Unfortunately, the user experience may be greatly diminished.

This website contains links to other websites. Aabalat is not responsible for the privacy practices of such other websites. We encourage our users to be aware when they leave our website and to read the privacy statements of each and every website that collects personally identifiable information. This privacy statement applies solely to information collected by this website.

Newsletter
If a user wishes to subscribe to our newsletter, we ask for contact information such as name and email address. If at any time you should wish to unsubscribe, simply opt out at the bottom of the next newsletter you receive using "Safe Unsubscribe."

Security
When our order form asks users to enter sensitive information (such as credit card number), that information is encrypted and is protected. While on a secure page such as our order form, the lock icon on the bottom of Web browsers such as Netscape Navigator, Mozilla Firefox and Microsoft Internet Explorer becomes locked, as opposed to unlocked, or open, when you are browsing.

Choice/Opt-out
Users who no longer wish to receive our electronic newsletter may opt-out of receiving these communications by simply opt out at the bottom of the next newsletter you receive using "Safe Unsubscribe."

Purchasing
Buyer in the USA certifies that he/she is at least 21 years of age. Buyer in the European Union certifies that he/she is at least 18 years of age. Buyer will have to certify to this on our secure order server prior to placing an order. Further certification may be required at time of delivery. The billing address needs to be the address on your credit card statement. Your billing address is where your order will be shipped. If you wish to ship to an address different than your billing address, please provide this information on your order form or call us at (707)-781-0619.

There is a $50 minimum for all orders not including shipping. If the item or items is below $50 you can add to the order or we can adjust the charge to meet the $50 minimum. We will contact you if the order is under $50. We are sorry if this is an inconvenience, but we have found that we lose money on orders under $50 when we factor in our labor charges.

All goods are supplied, ex-cellars, Petaluma, California, and must be paid for in full prior to delivery. Thus, all goods are sold in California and title passes to the Buyer in California. All shipping costs, including insurance, are to be paid by the Buyer. California sales tax is payable on all taxable goods delivered in California.

For "pre-arrival" or "futures" purchases, availability dates are estimates only. If Aabalat, for any reason, is unable to fulfill its obligations to the Buyer, Aabalat's sole obligation and the Buyer's sole recourse shall be a refund of the purchase price.

Aabalat reserves the right to refuse service to any customer or potential customer for any reason.

Shipping
We always recommend shipping to a business address where someone will be present to receive it during business hours. All shipping carriers require an adult signature at the time of delivery. Signature releases are not accepted. If the shipment is returned to us for an improper or incomplete address we will have to re-charge you for re-shipment, so please make sure the address is complete including business name, department or mail stop, if any, and suite number if going to a business complex.

By submitting an order to the Aabalat Fine & Rare Wines (www.aabalat.com) website you are stating that you are 21 years old or older (18 in the EEC), and warrant that you are legally able to purchase and consume alcoholic beverages at your place of delivery.

By submitting an order you hereby agree and understand that ALL ALCOHOLIC BEVERAGES ARE SOLD IN CALIFORNIA AND TITLE PASSES TO THE BUYER IN PETALUMA, CALIFORNIA. We make no representation to the legal rights and ability of anyone to ship or import wines into any state outside of California or any country outside the USA. YOU, the buyer, are solely responsible for shipment of alcoholic beverage products.

By placing an order for delivery in the USA, you authorize us to act on your behalf to engage a common carrier to deliver your order to you. ALCOHOLIC BEVERAGES MAY BE SOLD AND DELIVERED ONLY TO PERSONS WHO ARE AT LEAST 21 YEARS OLD AND BY PLACING YOUR ORDER, YOU REPRESENT AND WARRANT TO US THAT YOU ARE AT LEAST 21 YEARS OLD AND THAT THE PERSON TO WHOM DELIVERY WILL BE MADE IS AT LEAST 21 YEARS OLD AND CAN ACCEPT DELIVERY OF ALCOHOLIC BEVERAGES. When your alcoholic beverages are delivered, the person receiving delivery will be required to show identification proving that he or she is at least 21 years old. If any person under 21 years of age fraudulently orders and has wine shipped to them, the wine will not be released to them, and will be returned to us, and the cost of return shipping will be charged to the responsible party. BY ORDERING YOU AGREE TO INDEMNIFY AND HOLD HARMLESS THE SELLER FOR ANY RESULTING CONSEQUENCE OF A FRAUDULENT ORDER OR ANY MISREPRESENTATION AS TO THE AGE OR LEGAL ABILITY OF ANY INTENDED RECIPIENT TO RECEIVE SHIPMENT OF ALCOHOLIC BEVERAGES.

If you change your order after it is prepared for shipping, we reserve the right to charge for additional handling and packaging materials.

Parents or legal guardians will be held responsible for actions of their minor children. If necessary, legal action will be taken against any and all parties attempting "wire fraud." The cost of shipping to, and returning to us of any wine in any such operation will be charged to that agency. NO EXCEPTIONS.

We cannot ship to PO, APO, or FPO box offices. We currently do not ship to UT, KY, NC. Orders to Alaska or Hawaii must only be shipped 2nd Day Air. Incorrect, insufficient or change of address will incur a $10.00 surcharge. We reserve the right to charge return shipping for refused or undelivered packages. Please allow up to 2 business days for your order to be processed.

If you refuse the delivery of an order for any reason, you will be held responsible for return shipping charges in addition the original shipping charges. Aabalat does not issue refunds for shipping charges.

Shipping Conditions

Aabalat assumes no liability for wine damaged due to poor weather during shipping. This can include leakage, freezing, or corks pushing out of the neck.

Aabalat reserves the right to hold shipment of your wine during extreme weather conditions. Aabalat cannot be responsible for damage to wine (including leakage or damaged corks) shipped during extreme weather conditions. Please be aware of the scheduled delivery information, such as the date and location of your delivery as it cannot be changed once it leaves our warehouse. It is your responsibility to be present when your shipment arrives.

If the weather is very hot or cold in your area and you would like us to postpone your shipment, please advise us. Aabalat is not responsible for wine damaged during tranist due to hot or cold temperatures. At your request we will store your order free of charge when the weather is not suitable for shipping.

We do not advise shipping via ground during temperatures over 80°F (26°C) or under 32°F (0°C). We do not advise shipping during temperatures over 90°F (32°C). If you need your order by a specific date, please let us know and we will work with you to try to get the wine to you in time for your needs.

Aabalat cannot be responsible for wine damaged by a shipper or inappropriate storage/handling on the part of the shipper.

International Orders
Shipping for international orders will be quoted by email.

Pricing Errors and Omissions Excepted
Occasionally, our listed prices or bottle sizes may be incorrect. For example, a 750ml size may be incorrectly priced as a 375ml bottle. When such situations occur, Aabalat shall be held harmless for the error. We make every effort to make sure that our product database is accurate, however mistakes do happen. We will not be responsible for typographical errors. In all cases, the customer will be contacted before any charges are made to the credit card for a decision to proceed or not proceed with the order at the correct price.

Returns
All requests for returns or cancellations must be made within 7 days of the invoice date, no exceptions. Because of the fees charged by your credit card company when we charge and subsequently credit your card, we will enforce the collection of our restocking fee if your card has already been charged. We charge your card when your order is pulled from inventory and reserved for you. If we haven't charged your credit card, you may cancel the order without being subject to our restocking fee. If we have already charged your card, the cancelled processed credit card order for wines in-stock, shipped or not, are subject to a 15% restocking fee. Please check your order receipt carefully to make sure you ordered the correct wine. We will not be responsible for any incorrect orders placed by you, the customer. Any incorrect orders that are processed and shipped will be subject to a 15% restocking fee, as well as shipping charges back to us if you want to return the item(s). The prices for wine can fluctuate greatly from day to day, because of this we do not accept returns for wines based on price changes within the marketplace.

All items are sent insured. If you receive an item that has been damaged in shipping you must contact us immediately. It is standard policy for all shipping companies that you must save all packaging and the broken items for inspection by the insurance adjuster. Without the broken items and original packaging, there is no way to file a claim. If you do not save the items and packaging, we cannot accept returns or file a claim on your behalf.

Applicable Law and Venue

These terms and conditions are governed by and construed in accordance with the laws of the State of California, applicable to agreements made and entirely to be performed within the State of California, without resort to its conflict of law provisions. You agree that any action at law arising out of or relating to these terms and conditions can be filed only in state or federal court located in Santa Rosa, California and you hereby irrevocably and unconditionally consent and submit to the exclusive jurisdiction of such courts over any suit, action or proceeding arising out of these terms and conditions.

Sales Tax
All wine is sold in the state of California and the title passes to the buyer in California. All purchases shipped to California addresses will be subject to a 9.0% sales tax.

Customer Satisfaction
Aabalat sells quality products and service. Your satisfaction is our first priority. If for any reason you are dissatisfied with your order, please contact us within 14 days of the date of your order for customer care assistance. For fastest results, contact us by emailing customercare@aabalat.com. As is tradition in the wine trade, all bottles are purchased at the buyer's risk. Aabalat cannot be responsible for "corked" bottles. Aabalat makes no warranty, expressed or implied, about the wine being sold except that Aabalat is conveying clear title to the wine and to the best of Aabalat's knowledge, the wine is what its label describes it to be. Specifically, because wine by its nature is subject to change in the bottle over time, Aabalat makes no warranty or guaranty of the quality or drinkability of any wine sold. THE WARRANTIES SPECIFIED IN THIS CONTRACT ARE IN LIEU OF ANY AND ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. If you're not happy with a purchase, please contact us so we can try to work out an agreeable resolution.

All wine sold by us is maintained at optimum conditions. We consider wine to be out of our control once it has been handed over to the shipper and we cannot be responsible for improper storage after it has been shipped, and as such we cannot accept returns for the following:

Wines that do not coincide with personal tastes.
Wines that have been adversely affected by customer's storage.
Any other adverse condition affected while out of Aabalat's care.
